BOOKING TERMS AND CONDITIONS

 

Please ensure you read and understand the following terms and conditions pertinent to your accommodation rental. If you have any queries, please do not hesitate to contact us for clarification before you sign the booking form.

 

Whilst we reserve the right to increase or decrease accommodation prices at any time, we will confirm to you the current price at the time of booking.  As soon as you have confirmed your booking and paid your deposit or full payment, the cost of the rental is guaranteed against any further increase.  This guarantee is offered subject to our terms and conditions and payment being adhered to and providing you do not make further amendments to your holiday arrangements.

 

Yours holiday home rental includes: accommodation as booked, including services, e.g. gas, water and electricity, but excludes pool heating unless otherwise stated.

 

NOT included in our rental prices, are FLIGHTS, Car Hire, Holiday Insurance or Pool Heating (see note 11 on Pool heating).

 

BOOKINGS ARE VALID AFTER:

 

a)    The booking form AND Terms and Conditions has been completed, signed and received by the Owner.

 

b)    The appropriate deposit has been paid.

 

c)     The booking has been confirmed in writing by the Owner to the Guest.

 

d)    The person who signs the Booking Form is authorised to agree the Terms and Conditions on behalf of all persons included on the Booking Form, including those substituted or added at a later date. The signatory must be a member of the party occupying the property and must be 21 years or over.  Bookings cannot be accepted from parties of young people under 21 years of age.

 

TERMS AND CONDITIONS

 

  1. A booking between the Owners and the person making the booking (the Guest) is valid only after the booking form has been completed, the appropriate deposit has been paid to the owner (or owner’s Agent) and the booking has been confirmed in writing.
  2. A non-returnable deposit of £300 /$400 is payable to secure your booking. The balance of the rental charge, together with the security deposit (Bond) referred to in 5 below, is payable not less than ten (10) weeks prior to the commencement of the rental period. Bookings made within 10 weeks of the commencement date, are required to pay full payment and security deposit (bond) with the booking form.
  3. The Owner will refund any security deposit (bond) that has been paid to them if cancellations have been made by the Guest.
  4. If the Guest fails to pay the final balance and security deposit at the prescribed time, the Owners reserve the right to cancel the booking by giving notice, in writing, to the Guest, and the Owner shall be entitled to recover all sums due from the Guest.
  5. A security deposit (bond) of £300 /$400 is payable with the final balance of the rental charges. This will be refunded upon the return of the keys of the property to the Lock Box and once confirmation has been received from the Agent that no loss or damage has occurred to the property, its furnishings or its contents, during the period of rental.
  6. The Guest agrees to pay the full cost of any breakages, losses or damage to the property (the Owner’s Property Manager will be sole arbitrators on cause of damage or loss).
    1. The Guest agrees to: take good care of the property and leave it in a Clean and tidy condition at the end of their holiday
    2. report any damage or loss immediately it is discovered to the Owner’s Property Manager
    3. permit the Owner or their Agents reasonable access to the property to carry out any maintenance if necessary
    4. not to sublet or share the property except with persons nominated on the Booking Form
  7. No liability is accepted by the Owner for loss of main services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supply of mains service, nor any actions taken in the vicinity of the property by any authority over which there is no control by the Owner.
  8. The Owners do not accept any responsibility or liability for loss or damage or changes caused by ‘force majeure’ events or any other event beyond the Owner’s direct control, nor any injury, however caused, as a result of the use of the property’s swimming pool, nor any loss or theft of luggage or personal property at any time in or about the property, or any location in the U.S.A.
  9. The Owner does not accept liability for injury, damage or loss caused by any reason or for any claim made as a result of this booking and/or the subsequent holiday.  The Guest is responsible for taking out an adequate insurance policy to cover all risks.  This waiver is also applicable to people visiting the property as guests of the Guest.  The Owner also does not accept any liability for injury, damage or loss caused, or for any such claim by a third party as a consequence of actions by the Guest and other people occupying the property during the period of let.
  10. A BBQ is provided for guests free of charge. If used this is at guests own risk and under the following conditions - (1) The guest will CLEAN AND MAINTAIN the BBQ - if the BBQ or surrounding deck area is found dirty after your departure a cleaning fee of £50 / $75 will be deducted from your security deposit. The BBQ when in use must always be placed on the provided mat. The Drip tray as well as any grease on the gas bottle and mat/deck MUST BE CLEANED. (2) The guest accepts that any damage or injury caused by the use of the BBQ will be their responsibility. The BBQ MUST NOT be left unattended when lit. (3) The BBQ must be covered and on the MAT when not in use. (4) The guest must purchase own gas if the bottle is empty - easily purchased from Ace Hardware, Walmart, Lowes, etc.
  11. If pool heating has not been asked for and paid at time of booking, an additional fee of £18/$28 per day will be levied if the Guest requires this. Pool heat will be switched on during the day ordered and may take some time to heat the pool to optimum temperature. This is controlled by the owner and cannot be altered by the Property Manager. Tampering with any part of the pool heater or controls is strictly forbidden and will involve the Guest being asked to leave the Villa immediately, with all deposits, monies paid forfeited.  Guests are advised NOT to allow unsupervised children to use the swimming pool, which is around 6’ at the deepest point.  The pools are NOT designed for diving and this activity is DANGEROUS! 
  12. Occupancy of the property is limited to 8/9 persons plus an infant. This is determined by the authorities within strict guidelines for fire safety. Please note that contravention of the above will render the booking void, all moneys paid will be forfeited and you will be asked to leave the Villa immediately without further compensation.
  13. In the unlikely event that circumstances beyond the reasonable control of the Owner necessitate the cancellation of the booking, the Owner reserves the right to cancel the booking at any time and shall only be liable to refund the monies already paid by the Client, or make alternative arrangements for the client.
  14. We have a strict NO SMOKING policy inside the house. Guests are welcome to smoke out in the pool area and lanai. If any evidence of smoking is found in the home, this will be regarded as a serious breach of contract and you will be asked to leave immediately.  All monies paid will be forfeited and you will be liable for a deep clean fee.  The same is applicable to our strict NO PETS policy,
  15. Complaints:  We sincerely hope that you do not have any!...but...in the unlikely event that you wish to register a complaint during your holiday, contact the Property Manager immediately and follow this up with a letter. Give a copy to them and send us a copy on your return. Unfortunately we are not always able to control the components of your rented accommodation and it is possible that an advertised facility may be withdrawn or changed due to circumstances beyond our control and for which we cannot accept liability.
  16. In accordance with the Local Homeowners Association rules, no truck or van, boat, trailer, recreational vehicle, commercial vehicle or other types of non-passenger vehicles, equipment, implements or accessories shall be parked, stored or otherwise kept on any portion of the property or elsewhere in Indian Creek.  The connection of the villa’s utility supplies to any external vehicle/appliance is strictly forbidden.
  17. There is an allowance of $10 for phone calls per visit. Any amounts used over this will be deducted from the security deposit. Please remember that phone calls to cell (mobile) phones will use up the allowance very quickly compared to landline calls.
  18. In the unlikely event of theft of belongings owned by a guest or the owner, the guest will be liable for replacement of any personal items, together with any loss sustained by the owner if it is found that the premises were left unlocked, or that the alarm had not been activated while out of the Villa.
  19. A Games Room has been provided for the use of all our guests.  This has replaced the garage and as such, indoor parking is not available.  There is however parking space for at least 2 vehicles in the driveway. All food and drink must be kept away from the games tables and any damage, spillages or breakages to any of the games equipment should be notified to the Property Manager.  Please note that darts, darts tips, pool cue tips, etc., can all be purchased inexpensively at WalMart – alternatively any breakage/replacement costs will be deducted from the security deposit.

 

WE STRONGLY ADVISE ALL OUR GUESTS TO TAKE OUT TRAVEL INSURANCE FOR YOUR WHOLE PARTY, WHICH INCLUDES CANCELLATION CHARGES COVER (UK GUESTS ARE ALSO ADVISED TO TAKE OUT A POLICY WHICH INCLUDES MEDICAL COVER) AS SOON AS YOU HAVE BOOKED ANY PART OF YOUR VACATION. IF YOU CHOOSE NOT TO DO SO, YOU NEED TO BE AWARE THAT YOU WILL PERSONALLY BE RESPONSIBLE FOR PAYMENT OF ANY CANCELLATION CHARGES WHICH MAY BECOME DUE.
